WHAT IS INCAPACITY PLANNING?

Incapacity planning is planning for unexpected incapacity (i.e. coma, mental disability, etc.). 

Life happens without giving us any sort of notice. An emergency occurs, you are hospitalized and you cannot make financial or healthcare decisions on your own. Someone that you know, someone that you trust, needs to be able to step in and make those decisions for you while you are unable to. Otherwise, your family would have to turn to the courts in order to have the legal rights to make decisions on your behalf. This can be a confusing and costly process. 

Having your incapacity plan in place also helps avoid tensions amongst family members in the event that there are any disagreements as to what your wishes are. You will have already made certain decisions for your agents to follow. 

  • Protect yourself and your family from having to go through Court procedures in order to obtain Conservatorship over your person and your estate. 
     

  • With the right set of legal documents in place, you can authorize your agents to pay your bills, make financial, or healthcare decisions on your behalf. 
     

  • Avoid unnecessary court intervention or family disputes  and nominate your agents.
     

  • Nominate someone you trust. Failure to nominate agents of your choosing could result in an un-wanted agent, appointed by the court, to care for your personal and financial affairs.
